KOREA TEACHING CONTRACT

The following is a general over view of a teaching ESL contract in South Korea. Contracts will vary and differ but most will and should include all of the following within.

<Number one>

1) The employee is hired by the employer and both parties agree as follows:

<Number two>

  1. The Employer wishes to engage service of the employee for him/her to work as an English teacher at the Employer’s school from _____________ to ______________ for 1 year and the Employee agrees to work under the terms and conditions of this contract.
  2. The contract may be renewed by mutual agreement.

<Number three—working hours>

  1. Conduction professional, well-planned lessons.
  2. Performing all duties related to the classroom work, such as Lesson preparation, Student Evaluation, Monthly Schedules, new student interviews, teacher meetings and workshops, (depending on school)

<Number four—monthly salary>

  1. The employer will pay the teacher a total monthly basic salary of ___________________ including four insurance payment (National pension, Medical insurance, Korean income tax, etc.) and taxes.

 

  • Severance Payment: The employer will pay ___________ won (the monthly salary) to the teacher after the completion of this contract. Severance maybe paid up to month after. Tax will be withheld. Any outstanding debts will be subtracted from the severance pay or final pay.
  • <Number five—housing>

    1. The employer will provide at least partially furnished living accommodations and electronic utilities (fridge, stove, gas range), or monthly housing allowance (the housing allowance option is usually 300-400 thousand won).
    2. The employee has to pay public utility fees (ex. Electric charges, mobile phone charges, cable service and water rates.)

    <Number six—vacation>

    Ten days is the average vacation time at most academies. Public schools usually 10 working days for winter vacation and 8 working days for summer vacation. Universities are longer.

    <Number seven>

    Teachers will not be allowed to teach private lessons outside of the place of employment without permission of the Employer for (E-2 visa holders).

    <Number eight>

    1. The staff of a school can observe and estimate an employee’s classes.
    2. The employer can advise the employee to improve the curriculum and teaching methods.

    <Number nine>

    1. In case of inevitable change of environment or institution, the employer an employee can change the contract by mutual agreement.
    2. If the employee terminates the contract, the employee has to give written notice within a specified time frame, usually 1 month.

    <Number ten>

    1. The employer has the right to terminate in whole or in parts as follows.
      1. In the case of observing rules in school and degrading him/herself as a school teacher.
      2. In the case of changing the teaching curriculum and contents without consultation with staff of the school (though this is very rare, if ever a real problem, unless repeated often.)
      3. In case of disturbing the teacher’s classes intentionally.
      4. Not following the local Korean laws, or coming to school while intoxicated.

      Number eleven

       

      Work Place (public schools)
      1. Employee shall work at a Work Place as designated by Employer, and the Work Place may be a school, Provincial Office of Education, training center, or any other educational institute located in Busan City.

       

      2. Employer may designate multiple Work Places for Employee.

       

      3. Employer may designate Employee to work at a Provincial Office of Education, training center or other educational institute while school is in recess. In this event, Employee shall not make a claim for any additional pay.

       

      Number twelve

       

      Work Hours (public schools)
      1. Employee shall work eight (8) hours per day for five (5) calendar days per week from Monday to Friday and shall not work on Saturdays, Sundays and any national holidays of the Republic of Korea

       

      2. The Work Hours of Employee may follow the normal work schedule of civil servants of the Koren Government; however, such Work Hours may be adjusted by Employer as he/she deems appropriate.

       

      3. Actual class instruction hours of Employee shall not exceed twenty-two(22) hours per week. If, however, Employee's actual weekly class instruction hours exceed twenty-two(22) hours due to supplementary class instruction, Employee shall be entitled to a supplementary class instruction pay(20 000won/hour). (other schools should specify teaching hours per week and over time pay. Private schools usually 30 teaching hours per week and (20 000 won/hour) over time. University contracts are usually for 12 teaching hours per week. Please note that 1 teaching hour is often equal to one 50 minute lesson.

       

      4. Employer may require Employee to work overtime in addition to normal Work Days and Work Hours. In this case, overtime pay will be provided(6,000won/hour).

       

      5. Special leave is usually written into a contract for public schools (other schools maybe negotiated), such as wedding, or family emergency, usually up to working days.

       

      <Number thirteen>

      Sick leave is specified in a contract and differs from school types. Private schools usually offer 3-5 paid sick days, or possibly more, depending on the school.
      Public schools will usually offer 11 paid sick days.

      <Number fourteen>

      A contract will mention income tax (3-5%), health insurance (50% paid by most private schools, and all public schools), as well as Korean national pension, (50% paid by employer. The lump sum national pension can be collected at the end of your working contract upon leaving Korea. You must show your registered alien card and return air ticket to the national pension office in City Hall area, across the main street from the large police station, 4th floor, along with bank account information.

    <Number fifteen>

    1. The employer will coordinate with the employee by mutual agreement.

          2. This contract is valid for one year and shall commence on the first day of employment.
          3. The employer will prepare for two contracts and share with the employee individually.
          4. The employer will inform the school schedule to the employee.

    <Number sixteen>

    The laws of the Republic of Korea shall govern this document.

    <Number seventeen>

    The following Employment Agreement is made between the following two parties.
